Terms of Service
Effective Date: October 14, 2026
1. Acceptance of Terms
These Terms of Service ("Terms") govern access to the website operated by Start Now Services ("Company") and the purchase and use of its coaching, consulting, training, and related professional services ("Services").
By accessing the website, scheduling an appointment, purchasing Services, or otherwise engaging the Company, you ("Client") acknowledge and agree to be bound by these Terms.
If a separate written agreement between the Company and a Client expressly conflicts with these Terms, the provisions of that agreement shall control with respect to the applicable engagement.
2. Scope of Services
The Company provides career coaching, professional development, leadership development, strengths-based coaching, organizational consulting, workshops, and related advisory services to individuals and organizations.
The scope, duration, fees, deliverables, and other engagement-specific conditions shall be established through applicable service descriptions, booking confirmations, proposals, or written agreements.
The Company reserves the right to modify its service offerings, availability, and pricing at any time, provided that such modifications shall not retroactively alter confirmed purchases or existing contractual obligations without agreement.
3. Professional Services Disclaimer
Services are educational, developmental, and advisory in nature.
The Company does not guarantee employment, interviews, job offers, promotions, compensation increases, organizational performance improvements, or any other specific outcome.
Clients retain sole responsibility for their professional decisions, actions, and implementation of recommendations.
Services do not constitute legal, financial, medical, psychological, or other regulated professional advice.
4. Scheduling and Attendance
Appointments shall be scheduled through the Company's designated scheduling system or by direct arrangement.
Clients are responsible for attending appointments as scheduled and maintaining the equipment, connectivity, and other resources necessary for participation.
Late arrival shall not entitle a Client to an extension of the scheduled session.
The Company reserves the right to reschedule appointments when reasonably necessary and shall make reasonable efforts to provide timely notice and alternative scheduling arrangements.
5. Cancellation and Rescheduling
Individual Coaching Services
Clients must provide a minimum of forty-eight (48) hours' notice to cancel or reschedule an appointment.
Appointments canceled or rescheduled with less than forty-eight (48) hours' notice, and appointments missed without notification, shall be treated as completed sessions and shall not be eligible for refunds or replacement appointments, except as required by applicable law.
Exceptions may be granted at the Company's discretion.
Organizational and Corporate Engagements
Cancellation, postponement, and rescheduling requirements for organizational consulting, workshops, group coaching, and training engagements shall be governed by the applicable written agreement.
6. Fees, Payments, and Refunds
Payment is due at the time of purchase or booking unless otherwise specified in writing.
All purchases are final and nonrefundable, except as required by applicable law or expressly provided in a separate written agreement.
This policy applies to individual coaching sessions, coaching packages, prepaid professional development services, and other applicable purchases.
Where the Company is unable to deliver a purchased Service, the Company shall offer rescheduling, an equivalent alternative, or a refund for the undelivered Service, as appropriate.
Clients are responsible for reviewing service descriptions, pricing, cancellation requirements, and applicable conditions before completing a purchase.
7. Coaching Packages
Unless otherwise specified in writing, prepaid coaching packages are subject to the following conditions:
All included sessions must be completed within six (6) months of the original purchase date.
Unused sessions expire upon conclusion of the six-month period, subject to applicable law.
Coaching packages are nonrefundable except as required by applicable law.
Packages are nontransferable without prior written authorization.
Sessions canceled outside the required notice period or missed without notification shall be deducted from the remaining package balance.
Extensions may be authorized by the Company at its discretion.
8. Client Conduct and Responsibilities
Clients shall provide accurate information, participate in good faith, and conduct themselves professionally.
The Company reserves the right to suspend or terminate Services in response to harassment, threatening or abusive conduct, nonpayment, material misrepresentation, or other conduct that substantially interferes with the professional relationship.
Any resulting payment or refund obligations shall be determined under the applicable agreement and governing law.
9. Confidentiality
The Company shall exercise reasonable care in protecting confidential personal and professional information disclosed during coaching and consulting engagements.
Confidential information shall not be disclosed to unauthorized third parties except with consent, as required by law, or as otherwise permitted under the applicable agreement.
Coaching confidentiality does not establish a legally privileged relationship equivalent to attorney-client, physician-patient, or psychotherapist-patient privilege.
For employer-sponsored coaching and organizational engagements, the scope of reporting, information sharing, and confidentiality obligations shall be established in the applicable written agreement.
10. Assessments and Third-Party Materials
Services may incorporate CliftonStrengths or other third-party assessments, resources, and professional development tools.
Use of such materials may be subject to separate licensing agreements, fees, and provider terms.
Assessment results are intended for developmental purposes and do not constitute definitive evaluations of employment suitability, capability, or future performance.
References to third-party products or services do not imply sponsorship, affiliation, or endorsement unless expressly stated.
11. Intellectual Property
All original content, methodologies, presentations, training materials, worksheets, and other intellectual property developed or owned by the Company shall remain the exclusive property of the Company unless otherwise agreed in writing.
Clients are granted a limited, nonexclusive, nontransferable license to use materials provided in connection with purchased Services for personal or internal organizational purposes.
Unauthorized reproduction, distribution, resale, sublicensing, or commercial exploitation is prohibited.
12. Recording and Reproduction
Audio or video recording of coaching sessions, consulting meetings, or training programs requires appropriate prior notice and consent consistent with applicable law.
Any authorized recording shall be subject to applicable confidentiality, privacy, and intellectual property obligations.
13. Third-Party Platforms
The Company may utilize third-party platforms for scheduling, payment processing, video conferencing, assessments, and other operational functions.
Use of these platforms may be subject to the respective providers' terms and privacy policies.
The Company does not control independently operated third-party services and is not responsible for their acts or omissions except to the extent liability is imposed by applicable law.
14. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the website and Services are provided without warranties of any kind, whether express or implied, except as expressly established in a written agreement.
The Company makes no warranty that website access will be uninterrupted, error-free, or free from technical limitations.
Nothing in this provision excludes warranties or protections that cannot lawfully be disclaimed.
15. Limitation of Liability
To the fullest extent permitted by applicable law, the Company shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website or Services.
To the fullest extent permitted by law, the Company's aggregate liability arising from a particular paid Service shall not exceed the amount paid by the Client for that Service during the twelve (12) months preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New Hampshire, United States, without regard to conflict-of-law principles, except where otherwise required by applicable law.
17. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in effect to the fullest extent permitted by law.
18. Amendments
The Company reserves the right to revise these Terms periodically.
Updated Terms shall be published on the website with a revised effective date. Amendments shall not retroactively modify existing contractual obligations without appropriate agreement or legal authority.
